Tocsin Terms of Service

By installing or using Tocsin from the Shopify App Store, you ("Merchant," "you") agree to these Terms. If you do not agree, do not install the app.
1. What Tocsin does
Tocsin is a monitoring application for Shopify stores. We:
- Read your orders, products, and inventory via Shopify's official APIs
- Compute a baseline of "normal" hour-by-hour activity for your store
- Send you an email and/or Slack message when our detection rules conclude something looks broken (revenue anomaly, low stock on top sellers)
Tocsin is a best-effort monitoring service. We are not a substitute for Shopify's own systems, your payment processor's monitoring, your hosting provider's status pages, or your own operational oversight.
2. Service level — what we do NOT promise
- No SLA. We do not promise any uptime percentage, alert latency, or guaranteed delivery time. We will use commercially reasonable efforts to keep the service available and to deliver alerts within minutes of detection, but no specific deadline is guaranteed.
- No guarantee of detection. Tocsin uses statistical detection on your trailing 4-week history. We may fail to detect a real problem (false negative) or alert you on a situation that turns out to be fine (false positive).
- No financial guarantee. If Tocsin fails to alert you, or alerts you late, we are not liable for any revenue, profit, customer satisfaction, or business goodwill you lose. Tocsin is informational only.
- No support SLA. We respond to email at our best effort, typically within 2 business days, but do not promise a specific response time.
3. Billing and trial
- Trial. New installations receive a 14-day free trial. No charge during the trial.
- Price. $29 USD per month after the trial, billed via Shopify Managed Billing. One plan; no add-ons, no per-store charges.
- Cancellation. You can cancel any time by uninstalling Tocsin from your Shopify admin. Shopify stops billing immediately.
- Refunds. Because Shopify Managed Billing handles charges, refund requests are processed by Shopify per their refund policy. We do not offer pro-rated refunds for partial months.
- Price changes. We may change the price with 30 days' written notice via in-app banner and to the email on file.
4. Acceptable use
You agree not to:
- Reverse-engineer or attempt to access Tocsin's underlying systems beyond what Shopify exposes
- Resell or sub-license Tocsin's alerts to third parties
- Use Tocsin to monitor a store you do not own or are not authorized to monitor
- Submit false email addresses or Slack URLs
5. Your data and privacy
Tocsin's handling of your store data is governed by the Privacy Policy, incorporated by reference. Briefly:
- We do not collect or store your end-customers' PII
- We delete everything we hold about your store within 48 hours of uninstall
- We do not sell your data, run analytics on it, or feed it to AI training
6. Intellectual property
Tocsin's code, design, branding, and detection methodology are owned by Thomas Shelton. You receive a non-transferable, non-exclusive license to use Tocsin while your subscription is active.
You retain all rights to your store data. We process it solely to operate the service.
7. Termination
Either party may terminate this agreement at any time:
- You: by uninstalling Tocsin from your Shopify admin
- Us: by sending notice to the email on file, with reasonable cause (e.g. violations of §4 above). We will refund any unused portion of a paid period billed within the prior 30 days.
On termination, we delete all your data within 48 hours as described in the Privacy Policy.
8. Limitation of liability
To the maximum extent permitted by law:
- Our total liability to you, for any claim arising out of or related to Tocsin, is limited to the amount you paid Tocsin in the 12 months preceding the claim.
- We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost revenue or lost customers, even if we have been advised of the possibility.
- We are not liable for failures caused by Shopify's APIs, your email provider, your Slack workspace, or other third-party systems outside our control.
Some jurisdictions do not allow the exclusion of certain damages; in those jurisdictions our liability is limited to the maximum extent permitted by law.
9. Indemnification
You agree to indemnify and hold harmless Thomas Shelton from any claim arising from your use of Tocsin in violation of these Terms or applicable law.
10. Changes
We may update these Terms. We will notify active merchants via in-app banner and to the email on file at least 30 days before any material change. Continued use after the effective date constitutes acceptance.
11. Governing law and disputes
These Terms are governed by the laws of Tennessee, United States, without regard to its conflict-of-laws rules.
Any dispute will be resolved by binding arbitration in Tennessee under the rules of the American Arbitration Association, except that you may bring claims in small-claims court if eligible.
